Tweedie’s Concierge is owned and operated by Tweedie’s Concierge LLC.

By using the website and services, you agree to be bound by these terms and conditions and our Privacy Policy. In these terms, "we", "us", "our" and Tweedie’s Concierge refer to Tweedie’s Concierge and "you" and “your" refer to you, the Tweedie’s Concierge user.

The following terms and conditions apply to the website and services offered by Tweedie’s Concierge. This includes the mobile and tablet versions as well as any other version of Tweedie’s Concierge accessible via desktop, mobile, tablet, social media or other devices.

READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR OBTAINING ANY INFORMATION OR SERVICE FROM TWEEDIE’S CONCIERGE.

1. ACCEPTANCE OF TERMS

This agreement sets forth legally binding terms for your use of Tweedie’s Concierge. By registering and using the website, you agree to be bound by this agreement. If you do not accept the terms of this agreement, you should not use the website and discontinue use of the service immediately. We may modify this agreement from time to time, and such modification shall be effective upon its posting on Tweedie’s Concierge. You agree to be bound by any modification to this terms and conditions when you use Tweedie’s Concierge after any such modification is posted; it is therefore important that you review this agreement regularly.

The use of the services is available to persons over 18 years of age. Use of the services by persons under the age of 18 is prohibited. Tweedie’s Concierge reserves the right to make the necessary verifications during registration.

Tweedie’s Concierge may, in its sole discretion, refuse to offer the services to any entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the service and the platform is revoked in such jurisdictions.

The website and services may only be used in compliance with these terms and all applicable local, state, national and international laws, rules and regulations.

By using the website and services, you represent and warrant that you have the full right, power and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into this agreement.

2. ACCOUNT 

If you register on Tweedie’s Concierge, you will be required to choose a password, and you may be asked for additional information regarding your account. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Tweedie’s Concierge of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. You may never use another user’s account without prior authorization from Tweedie’s Concierge. Tweedie’s Concierge will not be liable for any loss or damage arising from your failure to comply with this agreement.

By providing Tweedie's Concierge with your email address and phone number, you agree that we may use your email address to send you notifications about the status of your order, important communications about our services, news and special content. We may also use your email address and phone number to send you notifications via SMS messages, push notifications and other messages, such as changes to service features, news about our services and special content. If you do not wish to receive these emails, SMS messages or push notifications, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in emails or by replying with the word "STOP" to SMS messages. Opting out may prevent you from receiving emails, SMS messages and push notifications about updates to your order or our services, news and special content. 

Users may cancel their accounts at any time and for any reason by following the instructions on the platform or by sending us their request through our contact information. That termination will only result in the deletion of the account and the deletion of all the personal data granted to Tweedie’s Concierge.

Tweedie’s Concierge reserves the right to terminate your account or your access immediately, with or without notice to you, and without liability to you, if Tweedie’s Concierge believes that you have breached any of these terms, furnished Tweedie’s Concierge with false or misleading information, or interfered with use of the platform or the service by others.

3. SERVICES AND PLANS

Tweedie’s Concierge offers the following services:

· Schedule Rides (Uber and Lyft rides)

· Meal Delivery

· Grocery Pickup

· Pharmacy Pickup

· Dry Clean Pickup

· Post Office Service 

· Doctor Appointment Companion 

· Schedule Reminders 

· Schedule Reservations 

· Misc errands (In case you do not find a service in the list, you can request it through our contact information.)

The user must request the service through our phone line (1-800-403-1321) or make the request through our website (online request). The services will be provided by our runners called “Errand Birds”, who will be in charge of running the errands and performing the services requested by the users. Once the user makes the service request, he will be assigned an Errand Bird according to his location and service request, who will be in charge of fulfilling and completing the requested errand.

Tweedie's Concierge will supervise and control the request and the respective Errand Bird until the completion of the service, notifying the user and the respective Errand Bird, about each stage of the order or for any novelty or setback that may arise during the errand, through SMS, WhatsApp or email notifications.

Tweedie’s Concierge will make every effort to ensure that our Errand Birds successfully complete your errands. In the event that for any reason the errand or service cannot be fulfilled successfully, Tweedie’s Concierge reserves the right to cancel the service and it will not be charged to the user or considered as a completed service.

Tweedie's Concierge offers services through the following monthly plans:

· Blue Bird Service

· Yellow Bird Service

· Platinum Bird Service

· The Baby Bird Service

Please check the price and features of plans before purchasing a plan. When a user purchases a plan, Tweedie’s Concierge will send a confirmation email. This confirmation email will occur automatically so that the user has confirmation of payment and initiation of the plan. If the user does not receive the email, it may have been sent to their spam folder. 

Tweedie's Concierge may change or discontinue the availability of plans at any time at its sole discretion. If a particular plan is cancelled, the payment made for the plan will be refunded in full. This does not affect your statutory rights.

Service plans are for the customer or contact person only and is non-transferable.

Plans may include automatic recurring payments. You authorize Tweedie’s Concierge to renew your plan and charge you periodically and progressively on each billing date. The billing date will be every 30 days and will be determined by the date on which you register, purchase the plan and make your first payment. On the corresponding billing date, the value of the fee will be automatically charged according to the plan that the user has chosen during registration. Your plan will continue until you cancel it or we terminate it. Users may cancel their plan at any time. You must cancel your plan before it renews to avoid the next billing period. We will bill the recurring plan fee in the form of payment you provide to us during registration or plan purchase. If you cancel your plan, you may continue to use the platform and features included in the plan until the next billing date.

Plans will automatically renew for an additional period unless cancelled prior to the next billing period. If you wish to reactivate your plan, you must purchase a new plan.

Important: please note that the cost of our services, rates, and fees do NOT include the fees and charges applied by Uber, Lyft, Doordash or any other entity. Our rates only include the cost of our concierge services through our Errand Birds. Any other services requested by the user through our concierge services will be billed to the user's account and charged to the user's credit or debit card.

4. PAYMENTS

Services and plans will be paid with the credit or debit card provided by the user at the time of registration. Payment for the plans will be automatically charged to your credit or debit card on each billing date according to the plan selected by the user.

In the case of services, the user authorizes Tweedie's Concierge to charge through the respective credit or debit card that the user has registered, for the third party services (Uber, Lyft, etc.) or goods that Tweedie's Concierge acquires on behalf of the user, in accordance with the respective invoices and charges for the third party goods and services which shall be included in the User's respective billing invoice.

Upon processing a transaction and issuing an invoice, we will issue an electronic receipt that will be sent to the email address you provided at the time of registration. The email and transaction receipt may be sent through our payment processor. 

User also authorizes Tweedie's Concierge to include the applicable charges for third party goods and services purchased by Tweedie's Concierge on User's behalf with the applicable charges, fees and charges for Tweedie's Concierge's services, on a single invoice.

If at the time of charging the corresponding invoice, your card is rejected, you will receive a notification indicating the error or problem. No payment will be charged to your card and the invoice payment will not be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorization. This usually takes 2 to 5 business days. Your card may be declined for a number of reasons, such as insufficient funds, AVS (Address Verification System) mismatch, or you have entered an incorrect security code.

If your payment is declined, you must provide an alternate payment method or provide another card on which the payment can be loaded and processed.

Tweedie's Concierge reserves the right to determine the price of services and plans and to change such prices at any time without notice.

Tweedie's Concierge may cancel any services or plans and not provide the services if it is reasonable to do so and may change or discontinue the availability of the services and plans at any time in its sole discretion.

5. SCHEDULE RIDES

Users will be able to request rides from platforms such as Uber and Lyft through our services. You agree and authorize that by using our Services, we may act as your agent on your behalf to attempt to obtain rides through third party platforms such as Uber and Lyft.

Users must indicate their location and destination at the time of requesting the service and Tweedie's Concierge will search for the driver that best suits their specifications, location and destination.

Once the driver is selected and the service is accepted by the driver, the user authorizes Tweedie's Concierge to communicate with the driver on their behalf for the purpose of monitoring the trip, assisting the driver with wrong directions or routes, course corrections, safety reasons or for any other reason or motive that Tweedie's Concierge deems necessary for the proper provision of the service.

The user will be able to register or select any third party or parties as "chosen" at the time of requesting the service or during registration. These users may be informed of the initiation, progress and completion of each ride you request through our services. By requesting a ride through our services, the user authorizes Tweedie's Concierge to communicate with the persons you designate as your chosen ones for the purpose of informing them about the start, progress and completion of the ride. The chosen ones will be informed about their ride only if requested by the user. Chosen ones will be informed via text message or email.

Upon completion of the ride, the total cost of the ride will be paid by Tweedie's Concierge. The user authorizes Tweedie's Concierge to subsequently charge and automatically debit the credit or debit card provided by the user at the time of registration for the exact value of the applicable ride. In some cases, we will use an authorization hold on your credit card or charge the final cost in a separate transaction.

In the event of any complaint or issue regarding the ride service or the driver providing the service, the user should contact Tweedie's Concierge to handle the complaint or issue with the relevant platform or driver on their behalf. Tweedie's Concierge will inform the user about the progress and resolution of the complaint or issue. You authorize Tweedie's Concierge to file as your agent and on your behalf any complaint or issue you may have with the ride service or the driver who provided the service and to monitor and report to you on the progress of the resolution of such complaint or issue.

Tweedie's Concierge will receive your complaint through our support service and will work promptly to resolve any complaint or issue you may have regarding the ride service or any of our services. You must provide us with the necessary information to enable a prompt and appropriate resolution to your complaint or issue.

Tweedie's Concierge does not guarantee or promise that rides requested by users can be obtained according to the user's specifications. Tweedie's Concierge is not responsible if drivers do not accept the trip request or drivers are not available in the user's pick-up area. Please note that Lyft, Uber or any ride service platform has no legal obligation to provide you with a ride.

6. DISCLAIMER

You agree and acknowledge that you will not use Tweedie's Concierge services in cases of medical emergency. In cases of emergency please seek emergency medical services. Tweedie's Concierge is not a provider of emergency medical transportation services.

You acknowledge that by using Tweedie's Concierge services, a unilateral contract for services is created between the parties and that Tweedie's Concierge has no obligation to provide the services but in the event of providing such services, you are legally obligated to pay for such services, in the event of non-payment for services provided by Tweedie's Concierge, we may use the legally established mechanisms to collect the amounts due according to the corresponding unpaid invoices.

By requesting a ride through our services, the user represents and agrees that Tweedie's Concierge does not own or operate any vehicles used for the ride service, nor is it an employer or contractor of any driver. Drivers who provide the ride services requested by users are partners and affiliates of the respective ride platform (Uber or Lyft) and are not employees of Tweedie's Concierge. Tweedie's Concierge also does not contract with companies that own vehicles used for the ride service nor does Tweedie's Concierge contract with companies that hire drivers.

You acknowledge and agree that in the event of any accident occurring during the progress of the rides, it shall be the sole and exclusive responsibility of the driver and the respective ride platform. The user acknowledges and agrees that Tweedie's Concierge does not carry independent insurance for any property damage or personal injury that may occur during the ride. In the event of any accident or incident, the user must initiate the respective process of claiming damages from the ride platform or the driver who provided the service.

You agree and acknowledge that Tweedie's Concierge's services are limited to acting on your behalf and as your agent and representative in obtaining third party products and services requested by our concierge services. Tweedie's Concierge services are limited to procuring third party products or services on behalf of our users. You AGREE to abide by the Transportation Network Companies Terms and Condition which will be accepted, on your behalf, by Tweedie’s Concierge.

Tweedie's Concierge does not supply the goods and services that are requested by users through our concierge services and is not responsible for the quality, accuracy, safety or legality of any third party products or services requested by our users through our concierge services.

The quality of third party products and services purchased through our concierge services is the sole and exclusive responsibility of the respective third party providers. 

Tweedie's Concierge is not responsible for failures to provide third party services requested by users. You understand and agree that situations beyond our control may arise where drivers may become lost, cancel service, have an accident during the pick-up route or fail to respond to requests Tweedie's Concierge communicates to you regarding your specifications. Tweedie's Concierge services and third party services requested by users are not infallible, the user accepts the risks that may occur during the provision of the services.

In the event that one or more users or any third party initiates any type of claim or legal action against Tweedie's Concierge, any and all users involved in such claims or actions release Tweedie's Concierge from any and all liability.

7. LICENSE TO USE THE PLATFORM

Tweedie’s Concierge gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Tweedie’s Concierge as part of the services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the services as provided by Tweedie’s Concierge, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

The user agrees not to use the platform and the services negligently, for fraudulent purposes or in an unlawful manner. Likewise, the user agrees not to partake in any conduct or action that could damage the image, interests or rights of the Tweedie’s Concierge platform or third parties.

This service prohibits sending of messages, that: (1) Any kind of messages that are catalogued as SPAM. (2) Are harassing, abusive, defamatory, obscene, in bad faith, unethical or otherwise illegal content (3) distribute trojans, viruses or other malicious computer software (4) Are intending to commit fraud, impersonating other persons, phishing, scams, or related crime (5) distribute intellectual property without ownership or a license to distribute such property (6) Breach, in any way, the terms of service, privacy policy or rules of this web site or the recipients.

Tweedie’s Concierge reserves the right to terminate your access immediately, with or without notice, and without liability to you, if Tweedie’s Concierge believes that you have violated any of these terms or interfered with the use of the platform or service by others.

8. THIRD-PARTY MATERIALS.

“Third-Party Materials” means any content, images, videos, texts or other material that is owned by a third party, such as stock images, videos and texts. Such Third-Party Materials are subject to the applicable third-party terms and licenses, and may only be used as permitted by such terms and licenses.

9. CONTENT

Through the platform Tweedie’s Concierge may make available to users, commercial and advertising information, own or third parties in accordance with good business practices. In these cases, Tweedie’s Concierge does not endorse, guarantee or commit its responsibility for the services and/or products marketed by these third parties, since the platform serves as a channel of communication and advertising, but not as a tool for the provision of services. Consequently, it is the full responsibility of the users to access the sites that refer advertising, assuming the obligation to verify and know the terms of the services offered by third parties.

10. COPYRIGHT

All materials on Tweedie’s Concierge, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Tweedie’s Concierge or by third parties that have licensed or otherwise provided their material to the website. You acknowledge and agree that all materials on Tweedie’s Concierge are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Tweedie’s Concierge prior express written permission. You may not add, delete, distort, or otherwise modify the material. Any unauthorized attempt to modify any material, to defeat or circumvent any security features, or to utilize Tweedie’s Concierge or any part of the material for any purpose other than its intended purposes is strictly prohibited.

11. COPYRIGHT INFRINGEMENT (Digital Millennium Copyright Act)

Tweedie’s Concierge will respond to all inquiries, complaints and claims regarding alleged infringement for failure to comply with or violation of the provisions contained in the Digital Millennium Copyright Act. Tweedie’s Concierge respects the intellectual property of others, and expects users to do the same. If you believe, in good faith, that any material provided on or in connection with the "Tweedie’s Concierge" website infringes your copyright or other intellectual property right, please send us your copyright infringement request pursuant to Section 512 of the Digital Millennium Copyright Act, via our contact information, with the following information: 

· Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers or a statement regarding ownership of the work should be included.

· A statement that specifically identifies the location of the infringing material, in sufficient detail so that Tweedie’s Concierge can find it on the "Tweedie’s Concierge" website. Note that providing a top-level URL is not sufficient.

· Your name, address, telephone number and email address.

· A statement by you that you have a good faith belief that the use of the allegedly infringing material is not authorized by the copyright owner, or its agents, or by law.

· A statement by you, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or authorized to act on its behalf.

· An electronic or physical signature of the copyright owner or of the person authorized to act on the copyright owner's behalf.

12. USER CONTENT 

Some features of the platform allow users to provide information and content through the website and the use of the services. You retain any rights you may have in the content and information you share through the website and use of the services. Tweedie’s Concierge is not responsible for the accuracy, security or legality of the content and information that the User provides and shares through the website. The user is solely and exclusively responsible for its content and information. Tweedie’s Concierge nor its directors, agents, employees and partners shall have any liability for the information or content provided by Users through the website.

13. REPRESENTATIONS AND WARRANTIES FOR USER CONTENT

Tweedie’s Concierge disclaims any liability in connection with the content and information you provide through the website and your use of the services. You are solely responsible for your content and information and the consequences of providing content and information through the website. By providing content and information through the website, you affirm, represent and warrant that:

· You are the creator and owner of the content or have the necessary licenses, rights, consents and permissions to authorize Tweedie’s Concierge to publish and display your content on the website.

· Your content and the use of your content as contemplated by these Terms, does not and will not: (i) infringe, violate or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, right of privacy, right of publicity, or any other intellectual property or proprietary right; (ii) libel, defame, slander, libel, or invade the right of privacy, publicity or other proprietary rights of any other person; or (iii) cause Tweedie’s Concierge to violate any law or regulation.

· Your content may not be considered by a reasonable person to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful or otherwise inappropriate.

· Your content or information does not and will not contain hateful content, threat of physical harm or harassment.

14. PERSONAL DATA

Any personal information you post or submit in connection with the services and use of the website will be used in accordance with our Privacy Policy. By using the services, you agree that we may collect and store your personal information. Please see our Privacy Policy.

15. PROHIBITED ACTIVITIES

The content and information available on the website (including, but not limited to, data, information, text, music, sound, photos, graphics, video, maps, icons or other material), as well as the infrastructure used to provide such Content and information, is proprietary to Tweedie’s Concierge or licensed to the Tweedie’s Concierge by third parties. For all content other than your content, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software or services obtained from or through the website. In addition, the following activities are prohibited:

· Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any content of the services, including but not limited to, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with this agreement or without our express written permission.

· Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services.

· Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.

· Deep-link to any portion of the services for any purpose without our express written permission.

· "Frame", "mirror" or otherwise incorporate any part of the services into any other websites or service without our prior written authorization.

· Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Tweedie’s Concierge in connection with the services.

· Circumvent, disable or otherwise interfere with security-related features of the services or features that prevent or restrict use or copying of any content.

· Download any content unless it’s expressly made available for download by Tweedie’s Concierge.

16. DISCLAIMER OF WARRANTIES 

Because of the nature of the Internet Tweedie’s Concierge provides and maintains the website on an "as is", "as available" basis and makes no promise that use of the website will be uninterrupted or entirely error free. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

Our website may from time to time contain links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use the website in breach of these terms you will be liable to and will reimburse Tweedie’s Concierge for any loss or damage caused as a result.

Tweedie’s Concierge will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Tweedie’s Concierge excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Tweedie’s Concierge and Tweedie’s Concierge shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

· Any incorrect or inaccurate information on the website.

· The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or any product or service purchased through the website.

· Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

· Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

· Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing or using content from the websiteor from transmissions via emails or attachments received from Tweedie’s Concierge.

· All representations, warranties, conditions and other terms which but for this notice would have effect.

17. Text Messaging and Phone Calls

By providing Tweedie’s Concierge with your phone number you agree that Tweedie’s Concierge may send you information by text or phone call as part of the normal business operations of your use of the Services. Tweedie’s Concierge may all send you account reminders and promotional calls that you may opt out of at any time.

18. ELECTRONIC COMMUNICATIONS

No responsibility will be accepted by Tweedie’s Concierge for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any Cleaner User, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes. 

19. INDEMNIFICATION

Under the terms of this Agreement and sufficiency of which is hereby acknowledged, do hereby indemnify, release, and forever discharge Tweedie’s Concierge including their agents, employees, successors and assigns, and any their respective heirs, personal representatives, affiliates, successors, and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, form any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now have or may hereafter have, arising out of or in any way related to any and all injuries, damages of any and every kind, to both person and property, and also any and all injuries and damages that my develop in the future as a result of or in any way relating to the Liability or Services or brought by third parties as a result of:

• Your breach      of this agreement or the documents referenced herein.
• Your      violation of any law or the rights of a third party.
• Your use of      the services.

20. CHANGES AND TERMINATION

We may change the website and these terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these terms. Your continued use of the site constitutes your acceptance of any changes to these Terms and any changes will supersede all previous versions of the terms. Unless otherwise specified herein, all changes to these Terms apply to all users take effect. Furthermore, we may terminate this agreement with you under these Terms at any time by notifying you in writing (including by email) or without any warning.

21. ASSIGNMENT

This agreement and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Tweedie’s Concierge without restriction.

22. INTEGRATION CLAUSE

This agreement together with the Privacy Policy and any other legal notices published by Tweedie’s Concierge, shall constitute the entire agreement between you and Tweedie’s Concierge concerning and governs your use of the website and the services.

23. DISPUTES

The user agrees that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the services, shall be resolved by binding arbitration between the user and Tweedie’s Concierge, provided that each party retains the right to bring an individual action in a court of competent jurisdiction.

In the event of a dispute arising in connection with the use of the services or the breach of these conditions, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organization as mutually agreed by the parties and in accordance with applicable commercial arbitration rules.

You agree to initiate a formal dispute proceeding by sending us a communication through our contact information. Tweedie’s Concierge may choose to send you a written offer after receiving your initial communication. If we offer and send you a settlement offer and you do not accept the offer, or we are unable to resolve your dispute satisfactorily and you wish to continue with the dispute process, you must initiate the dispute resolution process before an accredited arbitration organization and file a separate Demand for Arbitration. Any award rendered by the arbitration tribunal shall be final and conclusive on the parties. 

To the fullest extent permitted by law, you agree that you will not file, join or participate in any class action lawsuit in connection with any claim, dispute or controversy that may arise in connection with your use of the website and services.

23. FINAL PROVISIONS

These Terms and Conditions are governed by the laws of the United States, specifically the laws of the State of California. Use of the website and services are not authorized in any jurisdiction that does not give effect to all of the provisions of these Terms.

Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our Platform or information provided to or gathered by us with respect to such use.

If any part of these Terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these Terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.

Any rights not expressly granted herein are reserved.

24. LIMITATION OF LIABILITY

Tweedie’s Concierge Services may be used by you to request and schedule transportation, goods, or logistics services with third party providers, but you agree that Tweedie’s Concierge has no responsibility or Liability to you related to any transportation, goods or logistics services provided to you by transportation network companies other than as expressly set forth in these terms.

Tweedie’s Concierge does not guarantee the quality, suitability, safety or ability of the transportation network companies. You agree that the entire risk arising out of your use of the services, and any services or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.

The limitation and disclaimer in this section do not alter your rights as a consumer that cannot be excluded under applicable law.
